Terms of Service

These Terms of Service ("Terms") govern your use of SocialEngine ("SocialEngine," "we," "us," or "our"), a social media and marketing platform operated by Andre Kalkreuter as a California sole proprietorship. By creating an account or using the service, you agree to these Terms.

1. The service

SocialEngine lets self-storage operators schedule social media posts, generate marketing content, run Facebook and Instagram Lead Ads campaigns, and receive leads from those campaigns. We may add, change, or remove features at any time. We will give reasonable notice of material changes that affect how you use the product.

2. Your account

You must provide accurate information when you sign up and keep it current. You are responsible for safeguarding your password and for all activity under your account. You must be at least 18 years old to use SocialEngine. You must not share your account credentials with anyone outside your organization.

You retain ownership of the content you upload to or create inside SocialEngine ("Your Content"). You grant SocialEngine a limited license to store, process, display, and transmit Your Content solely to provide the service to you — for example, to publish a post you scheduled to your Facebook Page, to generate analytics for your dashboard, or to send a lead to your Lead Inbox. We do not use Your Content to train machine-learning models, and we do not sell it.

5. Third-party integrations

When you connect a third-party account (Meta, Google, Stripe, etc.), your use of that service remains governed by that service's own terms and policies. You are responsible for complying with them. You are also responsible for the content of any ads you run, including compliance with the Meta Advertising Policies.

6. Billing

Paid plans are billed monthly or annually in advance through Stripe. Subscription fees scale per location. Fees are non-refundable except where required by law, but you may cancel at any time from Settings → Billing, and your plan will remain active through the end of the current billing period. We will give reasonable notice of price changes.

7. AI-generated content

SocialEngine uses third-party AI providers (Google Gemini, Anthropic Claude) to generate captions, images, and other content when you request it. AI-generated content may contain inaccuracies. You are responsible for reviewing and approving any AI-generated content before publishing it. We provide AI output "as is" and make no warranty as to its accuracy, appropriateness, or fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your account if you materially breach these Terms, if we are required to do so by law, or if your use of the service creates a risk to SocialEngine or its other customers. You may terminate your account at any time from Settings → Billing. On termination, we will retain or delete your data as described in the Privacy Policy.

9. Disclaimer of warranties

SocialEngine is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any content generated by or delivered through the service will meet your requirements.

10. Limitation of liability

To the maximum extent permitted by law, SocialEngine and Andre Kalkreuter will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the service. Our total aggregate liability arising out of or in connection with these Terms will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.

11. Indemnification

You agree to defend, indemnify, and hold SocialEngine and Andre Kalkreuter harmless from any claim, damages, or expense arising out of your use of the service, your content, your ads, or your violation of these Terms or any applicable law or third-party right.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in California, and you consent to the jurisdiction of those courts.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and, for material changes, notify active users by email. Continued use of the service after changes take effect constitutes acceptance of the new Terms.
